Terms & Conditions

Business policies

All orders are subject to our terms and conditions (below). These conditions do not affect your rights as a consumer.

The Products

1. Photographs are for illustrative purpose only and may not exactly match the product itself.

2. Please be aware that all furniture has variants of colour and we therefore cannot guarantee exact colour matches.

3. Marsha's reserve the right to make any changes in the specification of the Products, which do not materially affect their quality or performance which are required to conform to any applicable statutory requirements.

Payment

 Full payment is required at the point of ordering.

Shipping, Returns and Cancellations.

1. Delivery of the products shall be made by Marsha's or his agent notifying you that the products are available for delivery, to such a place you may specify, at the time the order is placed.

2. Marsha's shall use its reasonable endeavors to meet any date agreed for delivery. You (the customer) will have the opportunity to refuse two delivery slots, after which time storage fees may be applied to the order.

3. In any event, delivery shall not be of the essence.

4. Marsha's shall not be liable for any delay in delivery ,however caused.

5. All orders for delivery to addresses within mainlaind GB are subject to a delivery charge.

6. For delivery to Northern Ireland, Isle of Man, Isle of Wight, Scottish Islands and Channel Islands we will deliver to a nominated mainlain GB address e.g a port. Onward shipping from that point, is the responsibility of the customers.

7. Generally where an order contains more than one product, all items will be delivered at the same time, once all goods are avaliable.

8. Where a delivery date has been agreed with our carrier but you (the customer) are not present to receive the delivery we reserve the right to charge you the full cost of the failed delivery.

9. We do not deliver on Sundays or Bank Holidays.

Damaged Goods

1. Every effort will be made to ensure that the goods you have ordered arrive undamaged and without defect.

2. If the goods are found to be either damaged or defected in any way at the time of delivery, you must explain what the problem is, on the delivery note, which will be provided by the delivery drivers. If damage is discovered after delivery, you must contact  us within 2 working days.

Returns Policy

1. If you (the customer) are dissatisfied with his purchase for any reason, you may within 2 working days inform our customer service department in writing to arrange collection of the product at your (the customers) expense.  On receipt of the goods, we will offer you an exchange or a credit note, providing we receive the goods in the same condition they were in at the time of delivery to you, including their original packing. Items which are not packaged at time of collection will not be collected and a charge of at least £35 will be deducted from you to cover cost of failed collection. Please note that this does not include upholstery or made to order furniture which cannot be returned. This does not effect your legal rights, including your right to claim a replacement or repair where the goods are faulty. No refunds will be given.

Acceptance of the Products

1. Other than where you act as a consumer (described in section 12 Unfair contract terms Act 1977). You shall be deemed to have accepted the products, 5 working days after delivery to you.

2. After acceptance, you shall not be entitled to reject products which are not in accordance of the contract.

Title & Risk

1. Risk of damage to or loss of the products shall pass to you upon delivery.

2. Notwithstanding any other provisions, herein title of the products shall not pass to you until Marshas have received  cleared funds payment in full.

3. You shall not be entitled to pledge or in any way charge by way of security for any indebtedness of any of the Products which remain the property of Marshas but if you do so, all moneys owing to Marsha's shall (without prejudice to any other right or remedy on Marsha's) immediately become due and payable.
